En respuesta a las presiones de los lobbies de la industria cultural sobre el parlamento Europeo y los parlamentos nacionales, se constituye una gigantesca coalición a escala mundial, que velará por el respeto de los derechos civiles de ciudadanos y artistas en la era digital.
Desde hoy se difunde mundialmente la "Carta por la innovación, la creatividad y el acceso al conocimiento".
Durante los pasados días, la prensa ha hecho eco del acuerdo al han llegado los órganos de gobierno europeos relativo a la "protección" del acceso a Internet. Es el llamado Paquete de Telecomunicaciones. El resultado ha sido una decisión ambigua, pero, afortunadamente, muy alejada de los deseos de los lobbies de la industria del entretenimiento, que pretendían imponer el corte del acceso a la Red de los ciudadanos.
Los matices que se añadieron en defensa de los derechos fundamentales y de las jurisdicciones de cada país han sido fruto del esfuerzo de cientos de organizaciones y millares de ciudadanos, que han hecho presión a los eurparlamentarios, y con ella han conseguido contrarrestar las presiones de los lobbies de la industria de Hollywood, editoriales del entretenimiento, entidades de gestión y equivalentes.
Este caso, como otros muchos previos, ha dejado manifiesto de la necesidad de la sociedad civil de organizarse y estructurar demandas firmes para que sus derechos sean respetados en la adaptación de las leyes a los nuevos avances estructurales de la era digital.
Más de 100 especialistas y organizaciones de gran relieve provenientes de 20 países diferentes han participado la semana pasada en el Foro de Cultura de Barcelona y han creado una coalición a escala mundial para el respeto de los derechos civiles de ciudadanos y artistas en la era digital. Este encuentro constituye el comienzo de una ofensiva sin precedentes de la sociedad civil en defensa de los derechos fundamentales en la era digital, desde los derechos de expresión, a los derechos de acceso a la cultura y al conocimiento, la defensa de un justo reparto de los derechos de autor y el reconocimiento del autor real, pasando por la inviolabilidad de las comunicaciones y de la privacidad y la neutralidad del acceso a Internet como grandes palancas de transformación de relaciones económicas, políticas, sociales y culturales.
Tras tres días de intenso trabajo se ha acordado la "Carta por la innovación, la creatividad y el acceso al conocimiento". La Carta, que invita los ciudadanos a sumarse a ella y a que la usen en sus reivindicaciones y demandas, será difundida mundialmente a través de interpelaciones oficiales y acciones virales de todo tipo.
La Carta se hará llegar a más de 1000 instituciones políticas y gobiernos, desde la OMPI hasta la administración Obama, pasando por la Comisión Europea y los gobiernos nacionales de todo el mundo. Algunas de estas organizaciones han manifestado ya su interés en escuchar las demandas, y dos representantes de la Comisión Europea y observadores oficiales del Ministerio de Cultura de Brasil estuvieron presentes, entre otras instituciones, en la aprobación de la Carta.
La campaña interpelará con particular atención el gobierno español, que ha exhibido la regulación del entorno digital como una de sus banderas.

A huge international coalition has come together to campaign for respect for the civil rights of citizens and artists in the digital era. Today they are launching internationally the Charter for Innovation, Creativity and Access to Knowledge. This initiative is a response to the pressure of the lobbies of the culture industry on the European Parliament and national parliaments, The Charter is an outcome of the Culture Forum held last week in Barcelona.
The press recently announced the accord reached by the European Commission on the “protection” of Internet access, the so-called Telecommunications Package. The agreeement is ambiguous but on the positive side, it is not granting the full demands of the culture industry lobbies which included the drastic measure of cutting off anyone who interchanged files on the Internet.
The changes added in defense of fundamental rights and in favor of the jurisdictions of each country were the results of the efforts of hundreds of organizations and citizens who pressured the European Parliament members and served to counteract the pressures of the culture industry lobbies.
This case, like many others, shows the need for civil society to organize and make firm demands so that their rights are respected in adapting laws to the new structural advances of the digital era.
More than 100 renowned specialists from 20 different countries participated last week in the Culture Forum of Barcelona and created a huge international coalition to urge respect for the civil rights of citizens and artists in the digital era.
This historic gathering, whose activities included coordinating the response to the final meeting of the commission on the Telecommunications Package, constitutes the beginning of an unprecedented offensive of civil society in defense of the fundamental rights in the digital era. These rights range from the right to freedom of expression to the right of access to culture and knowledge; the defense of a just division of authors' rights, the inviolability of communications and of privacy and the neutrality of access to the Internet. The Charter sees all these rights as great levers for the transformation of economic, political and social relations.
After three days of intense work, the Charter of the Culture Forum of Barcelona for Innovation, Creativity and Access to Knowledge was produced.
This Charter, which invites citizens to take it as theirs and use it in their requests and demands, will be disseminated worldwide through formal presentations to governments and also through a variety of actions by individuals and organisations.
The Charter will be presented to more than 1000 political institutions and governments, including WIPO, the Obama administration, the European Commission and many national governments. Some of these organizations have already shown an interest in listening to the demands, and two representatives of the European Commission and official observers from the Brazilian Ministry of Culture, among others, were present during the approval of the Charter.
The campaign will make a particular appeal to the Spanish government, which has made the regulation of the digital environment one of the flagship items in its upcoming presidency of the European Union. In 10 days the Charter will be delivered personally to “la infanta Cristina”, the daughter of the king of Spain.

In risposta alle pressioni delle lobby dell'industria culturale sul Parlamento europeo e sui parlamenti nazionali, una grande coalizione internazionale si è riunita per sollecitare il rispetto dei diritti civili dei cittadini e degli artisti nell'era digitale.
Diffondiamo oggi in tutto il mondo la Carta del Forum Cultura di Barcellona per l'innovazione, la creatività e l'accesso alla conoscenza.

Recentemente la stampa ha annunciato l'accordo raggiunto fra Consiglio dell'Unione e Parlamento Europeo sulla "protezione" dell'accesso a Internet, il cosiddetto Pacchetto Telecom. Si tratta di una decisione ambigua, ma per fortuna molto distante dai desideri della lobby dell'industria culturale, che voleva che chiunque scambi dei file venga escluso dall'accesso a Internet, punto.
I cambiamenti aggiunti in difesa dei diritti fondamentali e in favore delle giurisdizioni di ogni paese sono stati il risultato degli sforzi di centinaia di organizzazioni e cittadini, che hanno esercitato pressione sui membri del Parlamento europeo e che sono serviti a contrastare le pressioni della lobby dell'industria culturale.
Questo caso, come molti altri, dimostra la necessità per la società civile di organizzarsi e di esercitare ferme richieste affinché i loro diritti siano rispettati nell'adeguamento delle disposizioni legislative ai nuovi progressi strutturali dell'era digitale.
Più di 100 rinomati specialisti provenienti da 20 paesi diversi hanno partecipato la scorsa settimana al Forum della Cultura di Barcellona e hanno creato una grande coalizione internazionale per sollecitare il rispetto dei diritti civili dei cittadini e degli artisti nell'era digitale.
Questo incontro che, tra le altre cose, ha reso possibile il coordinamento di una risposta alla riunione finale degli organismi europei sul Pacchetto Telecom, costituisce l'inizio di un'offensiva priva di precedenti della società civile in difesa dei diritti fondamentali nell'era digitale, dal diritto alla libertà di espressione al diritto di accesso alla cultura e alla conoscenza; la difesa di una giusta divisione dei diritti d'autore; l'inviolabilità delle comunicazioni, della privacy e della neutralità nell'accesso a Internet, come grandi leve per la trasformazione delle relazioni economiche, politiche e sociali.
Dopo tre giorni di intenso lavoro, è stata prodotta la Carta del Forum Cultura di Barcellona per l'innovazione, la creatività e l'accesso alla conoscenza.
Questa Carta, che tutti i cittadini sono invitati ad assumere come propria e ad utilizzare nelle loro richieste e domande di diritti, sarà diffusa in tutto il mondo, attraverso presentazioni formali ai governi, ma anche attraverso azioni individuali.
La Carta sarà presentata ad oltre 1.000 istituzioni politiche e governi, incluse la WIPO o OMPI (Organizzazione Mondiale per la Proprietà Intellettuale), l'Amministrazione Obama, la Commissione europea e molti governi nazionali. Alcune di queste organizzazioni hanno già mostrato interesse ad ascoltare queste domande, e due rappresentanti della Commissione Europea e osservatori ufficiali del Ministero della Cultura Brasiliano sono stati presenti, tra gli altri, durante l'approvazione della Carta.
La campagna farà appello con particolare attenzione al governo spagnolo, che ha fatto della regolamentazione dell'ambiente digitale uno degli elementi di punta nella sua prossima presidenza dell'Unione europea. In 10 giorni, la Carta sarà consegnata personalmente a "La Infanta Cristina", la figlia del re di Spagna.
