This is the backstage wiki set up to support the common WORKING PROGRESS among the participant of  
the First International forum  on free culture and knowledge (Barcelona Oct 29 to Nov 1 2009). Do not consider  
the content on this wiki as final versions. The finalised things, and importandly the final versions and  
translations of the "Charter for innovation, creativity and access to knowledge" are availeble at

  • "The clause about reading diabilities is a bit out of place in that section and biased (why only reading disabilities? what about hearing or sensory disabilities?)" (SJ)

“I did a quick read through of the short and long versions. There is a ton of great stuff, but also some things that are unclear, eg

"There has to be a guarantee that all public domain works are accessible."

What does that mean? And

"Every jurisdiction should allow a work to be released in the public domain prior to the expiry of the copyright term."

If expiry of copyright is when something goes into the PD, "prior" doesn't make sense.

In US an copyright owner may release works to public domain whenever he or she wishes. In Europe (or most of it) this is impossible. This point calls for introducing public domain as a systematic solution to those legal system, which doesn't know it yet. Rekrutacja 05:00, 23 November 2009 (UTC)

And there are some things in the long version not at all in the short version.  Seems the long version should have the same directives, but with explanations.  Two that I like that is only in the long version:

"Sui generis database rights should not be introduced, and should be repealed in jurisdictions where they exist."

"There should be no copyright on laws, government reports, political documents and speeches, or regulatory compliance information."

And this one is good, but only in the short version, with no equivalent in the long version:

"The expansion of the public domain and contraction of the copyright term (less then 50 years)."

I suspect there is lots more like that.  I'd recommend a version 1.1 where the long and short forms are both generated from the same document.”

Section on patents ("Patents:Refer to A2K draft, Part4") looks more like placeholder, not final text. Rekrutacja 05:06, 23 November 2009 (UTC)

from fernando acero ATI: Por cierto, ya he visto que en la carta se habla de la ITU I-113 en relación a la definición de "Banda Ancha", lo que me parece genial.  ;-) . Aunque echo de menos en esta carta, en el apartado de la Administración pública el principio de Igualdad que aparece en la Ley 1/2007:

   "Principio de igualdad con objeto de que en ningún caso el uso de

medios electrónicos pueda implicar la existencia de restricciones o discriminaciones para los ciudadanos que se relacionen con las Administraciones Públicas por medios no electrónicos, tanto respecto al acceso a la prestación de servicios públicos como respecto a cualquier actuación o procedimiento administrativo sin perjuicio de las medidas dirigidas a incentivar la utilización de los medios electrónicos."

unspecific, and lacks a clear target. At FSFE, we put a lot of importance on being very clear in our political statements. We are happy to cooperate with other groups and come up with joint messages, but for us it is imperative that we maintain that clarity in everything we say and do. This allows us to be far more effective in policy processes than our limited resources would otherwise allow. SIMONA: i don't think we should report here this comment since is a mistake refered to the lecture of the summary. i think we should continue dscussing with them on this misundertanding...
